Michael D. Cundiff of Dearborn County, Indiana challenged his having to register as a sex offender for life on the grounds that the condition was applied to him even though his crime occurred before lifetime registration was mandatory in Indiana. However, there was case law supporting the lifetime registration. Cundiff further argued against the application of residency restrictions as his crime was committed prior to June 30,2006. He was successful on this point. Cundiff will have to remain on the sex offender registry for life but will not be subject to residency restrictions.
